Dilapidations

Hamilton Darcey LLP are experienced in all areas of dilapidations, with in-house experts who act for both landlords and tenants, covering a wide range of property sectors.

Our experience includes preparation and negotiation of landlord claims as well as defending claims on behalf of tenants. 

We also provide strategic advice for both landlords and occupiers in order to best deal with and plan for dilapidations, throughout the course of a lease.

Technical Due Diligence

Technical due diligence building surveys are a particular specialism of Hamilton Darcey LLP and we offer due diligence services for both purchasers and vendors. 

The due diligence process can be a significant obstacle to concluding purchases and sales of commercial property. Our service is designed to be efficient and professional. We tailor our advice by understanding what matters to investors, funders and owner-occupiers, which enables issues to be resolved quickly between parties.

Where necessary, we partner with our network of industry experts in other fields such as mechanical and electrical engineers, façade engineers and environmental assessors to give our clients a complete and thorough service.

Contract Administration

With a wealth of experience in performing the role of Contract Administrator and Employer’s Agent, Hamilton Darcey understand the need for a bespoke approach to take each project from inception through to completion.

With a primary focus on the requirements of our clients and with an eye on market trends, we advise on the most suitable procurement route to meet clients’ objectives and take responsibility for delivering projects to meet our clients’ expectations for time, cost and quality.

With a diverse knowledge base, we are well equipped to deal with a whole host of technical and statutory matters that may be required to prevent unforeseen delays, additional costs or design alterations, that would otherwise be encountered.

Party Wall and Neighbourly Matters

We act for both Building and Adjoining Owners as defined under the Party Wall etc. Act 1996 in all aspects of Party Wall instructions including reviewing proposed plans, serving and reviewing notices, producing Schedules of Condition, preparing and agreeing Party Wall Awards, assisting with appeals and consequences as well as dealing with any wider issues as and when they arise throughout the works.

We regularly assist developers in serving valid notices to all adjoining owners in order to facilitate works commencing as quickly as possible, whilst ensuring compliance with the Party Wall etc. Act 1996 to prevent project delays. We liaise with adjoining owners and their representative to carry out Schedules of Condition to surrounding properties, to act as a record of condition prior to works commencing. 

When acting for Adjoining Owners, whether you are landlord, head-lessee or a leaseholder, when acting as your Appointed Surveyor, we will ensure your property is property safeguarded and prevent unnecessary inconvenience from works to adjoining properties. 

Licence to Alter

Whether working for Landlords or Tenants, we bring efficiency and pragmatism to the process of Licences to Alter.

Our technical expertise across a wide spectrum of property and construction matters allow us to interpret tenant proposals and translate them to possible risks to the Landlord’s investment and work with the parties involved to overcome obstacles.

Our knowledge of dilapidations means we are also equipped to review any proposed licence documentation, so as to ensure our clients are not overly hindered at the end of the leasing term.

Defect Diagnosis

As Chartered Building Surveyors, we are qualified in diagnosing defects to all property types. Our services include the identification and remedy of all defect types, whether caused by poor building design, improper/ineffective maintenance or due to the presence of deleterious materials, ensuring you are able to maintain the value and safety of a property, whilst keeping disruption to occupiers to a minimum.

Planned Maintenance Programmes

Hamilton Darcey’s knowledge of building element lifespans enables us to produce maintenance programmes, which facilitates accurate budgeting of maintenance costs. This strategy also prevents the deterioration of the building elements, taking into consideration the most cost-effective ways to conserve the fabric of the building. 

By investing in a Planned Maintenance Programme you will be better equipped to manage service charge budgets which, coupled with properly maintained and presented buildings, means greater chance of tenant retention.

Reinstatement Cost Assessments

We provide valuations for the reinstatement of a building following complete or partial destruction for use by your insurers. Our valuations give consideration to demolition costs, rebuilding costs, any special features, professional fees, geographical area, the impact of legislative changes as well as determining whether the building is of listed status or is situated in a conservation area.

Land Registry Compliant Lease Plans

We provide Lease Plans for new leases in both the commercial and residential sector, using our in-house AutoCAD specialists.

We understand that Lease Plans can often be overlooked in the preparation of new leases and they often fall by the wayside. As such, we are set up to produce Lease Plans quickly and efficiently ensuring compliance with Land Registry requirements to prevent unnecessary delays to property transactions.

Interior Design

We provide Interior Design Services either on a stand-alone basis or as part of a Contract Administration instruction. We advise on the full spectrum of design options to achieve your individual requirements to ensure your building is keeping up with market trends and maintaining value.

As Chartered Building Surveyors, our interior design services span the full project lifecycle from inception through to completion. This incorporates proposed drawings for planning, building regulations and specifications together with the submissions to the local authority where necessary.

CDM Regulations 2015 and Principal Designer

The Construction Design and Management Regulations 2015 came into force on 6th April 2015. We act as Principal Designer for all project types and our core services include:

  • Providing pre-construction Health and Safety information to the Principal Contractor;
  • Review of Contractors’ Risk Assessments and Method Statements;
  • Monitoring works to ensure Health and Safety compliance.
